Private Land Parking Enforcement

A guide to protecting your car park from unauthorised use

Enforcement Guide

How to enforce parking on private land

If you own or manage private land with parking — whether it's a business car park, residential estate, or retail site — you have the right to control who parks there. This guide explains how enforcement works and what your options are.

unauthorised parking
The problem

Your car park is being used by people who shouldn't be there

Private land parking abuse is a growing issue. Commuters use business car parks as free park-and-ride. Shoppers park in residential bays. Unauthorised vehicles take spaces meant for staff, customers, or residents — and there's seemingly nothing you can do.

  • Staff and customers can't find parking spaces
  • Commuters treat your car park as free all-day parking
  • No way to identify vehicle owners to take action
  • Warning signs alone don't deter repeat offenders
You can enforce your rules

Private landowners have the legal right to control parking on their land. ANPR-based enforcement with DVLA access lets you identify offenders and issue enforceable Parking Charge Notices.

How it works

Private land parking enforcement explained

The legal framework and how enforcement operates.

The legal basis

When a vehicle parks on private land, they enter into an implied contract with the landowner. The terms of that contract are displayed on signage — "parking limited to 2 hours", "permit holders only", "customers only while shopping", etc.

If a driver breaches those terms, the landowner can pursue them for a parking charge. This is a civil matter (not a criminal offence) and is enforced through the civil courts if necessary.

The Protection of Freedoms Act 2012 allows operators to obtain vehicle keeper details from the DVLA, making it possible to identify the registered keeper and pursue the charge directly.

Key requirements
  • Clear signage displaying parking terms
  • Evidence of the breach (ANPR photos, timestamps)
  • DVLA-accredited operator to access keeper details
  • Fair appeals process for disputes
  • Compliance with industry codes of practice
Requirements

What you need to enforce parking

The essentials for effective private land enforcement.

Proper Signage

Clear signs at entrance and throughout the car park stating the terms and conditions — time limits, permit requirements, charges for breach.

ANPR Cameras

Number plate recognition cameras at entry and exit points to record vehicle movements and provide evidence of overstays or breaches.

DVLA Access

Accreditation to request vehicle keeper details from the DVLA, so you can send Parking Charge Notices to the right address.

PCN Generation

A system to create and send Parking Charge Notices with the correct wording, timeframes, and evidence requirements.

Appeals Process

A fair system for motorists to appeal charges, with access to independent adjudication if required by your code of practice.

Code Compliance

Membership of an Accredited Trade Association (IPC or BPA) to access DVLA keeper data and follow industry codes of practice.

FAQ

Common questions

Answers to questions about private land parking enforcement.

Yes. Landowners have the right to control who parks on their property. When proper signage is in place, parking on private land creates a contract between the driver and the landowner. Breaching that contract (overstaying, parking without permit, etc.) allows the landowner to pursue a parking charge as a civil matter.

The Protection of Freedoms Act 2012 allows parking operators who are members of an Accredited Trade Association (ATA) to request keeper details from the DVLA. MyCarPass integrates with the DVLA system to look up the registered keeper of any vehicle, so PCNs can be sent to the correct address.

Signs must be clearly visible at entrances and throughout the car park. They should state the parking terms (who is allowed, time limits), what happens if terms are breached (parking charge amount), and how to appeal. Codes of practice provide detailed requirements. We can advise on signage wording and placement.

If a motorist refuses to pay and loses their appeal, the matter can be escalated to debt recovery and ultimately to court. Most charges are paid after the initial notice or reminder. Having clear evidence (ANPR images, timestamps) and following code requirements makes court action more likely to succeed if needed.

Yes. MyCarPass lets you maintain a whitelist of permitted vehicles — staff, residents, regular visitors, contractors, etc. Whitelisted vehicles are automatically validated by ANPR and will never receive a PCN. You can add or remove vehicles at any time.

Charge levels are governed by the code of practice of your Accredited Trade Association. Currently, charges are capped at £100 (£60 if paid within 14 days) in most circumstances. The charge must be reasonable and consistent with what's displayed on signage.
